a general rule Article 1 (Purpose) The purpose of this agreement is to prescribe the rights, duties, and responsibilities of Wonderful Korea and its users in using e-commerce-related services (hereinafter referred to as "services") provided by the Internet auction site "Wexport" operated by Wonderful Korea Co., Ltd. 'E-commerce using PCs, smartphone apps, and wireless is also applied mutatis mutandis unless it goes against its nature. Article 2 (Definitions) 1. "Wexport" means a platform service (including e-commerce as an online automobile auction service) provided by a company to users for sale and price. 2. "User" means members and non-members who access "Wexport" and receive services provided by "Wexport" under these terms and conditions. 3. The term "member" means a person who has registered as a member of " Wexport" and who can continue to use the services provided by "Wexport". 4. "Non-member" means a person who does not subscribe to a member but uses the services provided by "Wexport". 5. The term "human member" means a person who has not used the service for at least one year among the "members" of "Wexport". Human members may be restricted from using the service in accordance with the policy of "Wexport", and in order to use the service again, they must perform the identification procedure set by " Wexport" for transaction safety. Article 3 (Explanation, explanation and revision of the terms and conditions, etc.) 1. "Wexport" means the contents of these Terms and Conditions, the trade name and the name of the representative, and the address of the place of business (including the address of the place where the consumer's complaint can be handled). When revising the terms and conditions, "Wexport" shall be announced on the initial page of "Wexport" together with the current terms and conditions from 7 days before the application date to the previous date. However, if the contents of the terms and conditions are changed unfavorably to the user, a preliminary grace period of at least 30 days is notified. In this case, "Wexport" clearly compares the content before and after the revision to make it easier for the user to understand. 5. If "Wexport" revises the terms and conditions, the revised terms and conditions apply only to contracts concluded after the application date, and to contracts already concluded before that date, the terms and conditions before the revision remain the same. However, if a user who has already signed a contract wants to be subject to the revised terms and conditions clause, the revised terms and conditions clause is applied to "Wexport" by sending it to "Wexport" within the notice period of the revised terms and conditions will be applied. 6. Matters not prescribed in these terms and interpretation of these terms and conditions shall be governed by the Consumer Protection Act, the Regulation of Terms and Conditions, and the relevant laws and regulations as prescribed by the Fair Trade Commission. company services Article 4 (Provision and Change of Services) ① "Wexport" performs the following tasks: 1.Provide pricing information and sign a purchase agreement with a car using "Wexport" 2. Providing a platform where "unified members" and "buyer members" who wish to sell and purchase vehicles through "Wexport" can exchange information (vehicle information subject to sale, price information, etc.) that they wish to deliver ② "Wexport" may change the contents of goods or services to be provided by a future contract in the event of a shortage of goods or services or a change in technical specifications. In this case, the contents of the changed goods or services and the date of delivery shall be specified and announced immediately to the place where the contents of the current goods or services are posted. ③ If the contents of the service contracted with the user are changed due to reasons such as out of stock, such as goods, or changes in technical specifications, the user is immediately notified of the reason as possible. ④ In the case of the preceding paragraph, "Wexport" compensates for the damage caused by the user. However, this is not the case if it proves that "Wexport" is not intentional or negligent. Article 5 (Discontinuation of Service) ① "Wexport" may temporarily suspend the provision of services in the event of maintenance inspection/replacement of information and communication facilities such as computers, failure, or communication disruption. a membership contract Article 6 (Membership registration) ① The user applies for membership by filling in the membership information according to the membership form set by "Wexport" and expressing his/her intention to accept this agreement. ② "Wexport" shall be registered as a member unless it falls under any of the following among users who have applied to join as a member as prescribed in paragraph (1): 1. Where an applicant for membership has previously lost his membership under Article 7(3) of this Agreement; provided, however, that this shall not apply where he/she has obtained approval for membership of "Wexport" after three years have passed since he/she lost his/her membership under Article 7(3). 2. If there is a false, missing entry, or incorrect entry in the registration content; 3. If it is deemed that registration as a member is significantly impaired in terms of the technology of "Wexport" ③ The period of establishment of the membership contract shall be the time when the consent of the "Wexport" reaches the member. ④ If there is a change in the matters registered at the time of membership registration, the member shall notify the "Wexport" of the change by modifying the member information within a considerable period of time. Article 7 (Withdrawal of membership and loss of qualification, etc.) ① Members may request "Wexport" to withdraw at any time, and "Wexport" promptly processes withdrawal according to the method notified by "Wexport" through the site when requested by the members. ② If a member falls under any of the following grounds, "Wexport" may restrict and suspend his/her membership: However, if the "Unified Member" violates the Dealer Member's Guide, it is in accordance with the separate Dealer Member Warning System policy, not in this paragraph. 1. When applying for membership, entering other person's information or false information, or missing or incorrect information in the contents of the membership; 2. Where a member fails to pay the amount of goods, etc. purchased using the "Wexport" or other debts to be borne by the member in connection with the use of the "Wexport" on the due date; 3. Threatening the order of e-commerce, such as obstructing the use of "wexport" by others or stealing the information 4. In the case of using "Wexport" to prohibit laws and regulations or these terms and conditions or to act contrary to public order and good manners; 5. In the event that the operation of the "Wexport" is impaired or the operation of the "Wexport" is hindered by the following actions: A. In the case of discrediting or disseminating groundless or false facts in connection with the operation of "Wexport", or discrediting "Wexport" or undermining the reliability of the "Wexport". B. In the case where the use of "Wexport" interferes with the operation of "Wexport" by verbally abusing, threatening, or obscene words or actions equivalent thereto to an employee; C. Where a vehicle or goods purchased through the "Wexport" are repeatedly canceled or returned without justifiable reason to interfere with the work of the "Wexport"; D. In the event that a vehicle or service purchased through "Wexport" is not particularly defective, it interferes with the company's business due to habitual cancellation, objection, etc E. If "Wexport" carries out identification procedures, it is not identified or confirmed that it is not the person, F. Where the personal information (name, phone number, address, etc.) of a member of the already subscribed "Wexport" is the same; Buy. Where a service is used for the purpose of pursuing fraudulent use or profit; Ah. Where it is suspected to be illegally used through member information such as the same/similar ID, phone number, address, etc Let's. Where a member who has received restrictions on services, suspension of membership, etc. from "Wexport" voluntarily terminates the use contract and applies for reuse during the period of such measures; J. In the case of unauthorized collection of goods, services, and information of "Wexport", or submitting, posting, or using it outside, infringing on intellectual property rights, such as copyrights and trademarks of "Wexport", ③ If the member falls under paragraph (2), measures may be taken to restrict or suspend the services provided to the member by "Wexport". ④"Wexport" may lose its membership if the same action is repeated more than twice or the reason is not corrected within 30 days after "Wexport" restricts/discontinues its membership. ⑤ If "Wexport" loses its membership, the membership registration is cancelled. In this case, the member shall be notified of this, and an opportunity to clarify for a period of at least 30 days before the membership registration is given. Article 8 (Notice to Members) ① "Wexport" may be made by e-mail, text, phone, fax, etc. designated by the member in advance with "Wexport" when notifying the member. ② "Wexport" can be replaced by individual notices by posting them as "Wexport" notices for at least one week in case of notices to an unspecified number of members. However, individual notification is given for matters that have a significant impact on the member's own transaction. Article 9 (Purchase and Sale) ① The "Wexport" buyer shall apply for the purchase of a vehicle on the "Wexport" by the following or similar means, and the "Wexport" shall provide the following information in a bid application by the buyer in an easy-to-understand manner: 1. Search and select vehicles, etc 2. Vehicle details and current location 3. Confirmation of the details of the terms and conditions, services that restrict subscription withdrawal rights, delivery fees, and other related expenses 4. A sign that agrees to these Terms and Conditions and confirms or rejects the matters in subparagraph 3, above (e.g., mouse click) 5. Consent to purchase and confirmation of vehicle, etc. or confirmation of "wexport" ② The "Wexport" seller shall apply for the sale of the vehicle on the "Wexport" in the following or similar manner, and "Wexport" shall provide the following information in the seller's registration of the sale in an easy-to-understand manner. 1. Vehicle details are disclosed through vehicle number inquiry 2. Posting videos and photos Article 10 (Establishment of a Contract) ① "Wexport" may not accept applications for individual service contracts, such as purchase applications by "Members", if they fall under any of the following: However, in the case of signing a contract with a minor, it must be notified that the minor himself or his legal representative can cancel the contract unless he obtains the consent of the legal representative. 1. If there is a false, missing entry, or incorrect entry in the application; 2. In the case where it is judged that consent to other purchase applications is significantly impaired in terms of "Wexport" technology; ② The contract shall be deemed to have been established at the time when the consent of "Wexport" reaches the user in the form of a receipt confirmation notice pursuant to Article 14 (1). ③ The expression of consent of the "Wexport" shall include information on the confirmation of the user's purchase application, availability of sale, cancellation of correction of the purchase application, etc. Article 11 (Notification of confirmation of bid/Change and cancellation of sales application) ①"Wexport" notifies the seller of the successful bid after the closing of the bid when the buyer bids or wins the bid. ②Upon receipt of the notice of confirmation of the successful bid, the seller can decide whether to make a successful bid, and apply for a sale, change, or cancel. Article 12 (Personal Information Protection) ① "Wexport" collects the minimum personal information to the extent necessary for providing services when collecting user personal information. ② When collecting/using the user's personal information, "Wexport" notifies the user of the purpose and obtains consent. ③"Wexport" shall not use the collected personal information for any purpose other than its purpose, and if a new purpose of use occurs or is provided to a third party, notify the user of the purpose and obtain consent. However, exceptions are made if there are other provisions in the relevant laws and regulations. ④ Where "Wexport" requires the consent of the user pursuant to paragraphs 2 and 3, it shall specify or notify the identity of the person in charge of personal information protection, the purpose of collecting and using information, and the information to be provided to third parties, and the user may withdraw the consent at any time. ⑤Users may at any time request access to and correct errors in their personal information held by "Wexport" and "Wexport" is obligated to take necessary measures without delay. If a user requests correction of an error, "Wexport" will not use the personal information until the error is corrected. "Wexport" or a third party receiving personal information from him shall destroy the personal information without delay when the purpose of collecting or receiving the personal information is achieved Article 13 (Obligations of "Wexport") ① "Wexport" shall do its best to provide vehicles, etc. continuously and stably as prescribed by this Agreement, without any prohibition or violation of the laws and regulations. ② The "Wexport" shall endeavor to protect the personal information of users so that users can safely use Internet services. Article 14 (Obligation for the ID and password of a member) ① The member is responsible for managing the ID and password. ② Members should not allow third parties to use their IDs and passwords. ③ If a member recognizes that his or her ID and password have been stolen or used by a third party, he or she should immediately notify "Wexport" and follow "Wexport" if any. Guitar Article 15 (User's Obligation) Users should not: 1. Register false information when applying or changing 2. Stealing other people's information 3. Change of information posted on "Wexport" 4. Transmission or posting of information other than the information specified by "Wexport" (computer programs, etc.) 5. Infringement of intellectual property rights such as copyrights of "Wexport" and other third parties 6. "Wexport" and other acts that damage the reputation of a third party or interfere with its business; 7. Disclosure or posting of obscene or violent messages, images, voices, or other information contrary to public morals on the site; Article 16 (Restriction on the attribution and use of intellectual property rights) ① Copyright and other intellectual property rights to the work created by "Wexport" belong to "Wexport". ② The user shall not reproduce, transmit, publish, distribute, broadcast, or allow third parties to use information attributed to intellectual property rights among the information obtained by using "Wexport" without prior consent from "Wexport". ③ "Wexport" shall notify the relevant user when using intellectual property rights attributed to the user pursuant to the agreement. Article 17 (Company Disclaimer) ① "Wexport" is exempt from liability for service delivery if it is unable to provide service due to a natural disaster or equivalent force majeure. ②"Wexport" shall not be responsible for any impediment to service use due to reasons attributable to the member. ③ "Wexport" shall not be liable for the loss of the revenue expected by the member using the service, nor shall it be liable for damages caused by the data obtained through other services. ④ "Wexport" is not responsible for the information, data, reliability, accuracy of facts, etc. posted by the members. We are a company that makes competitive bids for sales and sales information of cars such as accident vehicles and used vehicles through uploads of integrated and non-members, and "Wexport" is not responsible even if there is a discrepancy in the contents or mis-entry. ⑤ In the event of a dispute between users, "Wexport" strives to be resolved smoothly from an objective and neutral position, regardless of whether "Wexport" is legally responsible. Article 18 (Dispute Resolution) ① "Wexport" establishes and operates a damage compensation processing mechanism to reflect legitimate opinions or complaints raised by users and to compensate for the damage. ② "Wexport" deals with complaints and comments submitted by users first. However, if it is difficult to process quickly, we will immediately notify the user of the reason and the processing schedule. ③ If a user applies for damage relief in connection with an e-commerce dispute between the "Wexport" and the user, it may be subject to the mediation of the Fair Trade Commission or the dispute settlement agency commissioned by the city or provincial governor. Article 21 (Jurisdiction and Applicable Law) ① Litigation regarding e-commerce disputes between "Wexport" and users shall be based on the address of the user at the time of filing, and if there is no address, it shall be under the exclusive jurisdiction of the district court having jurisdiction over the residence. However, if the address or residence of the user is not clear at the time of filing, or if the resident is a foreign resident, the Seoul Central District Court is under exclusive jurisdiction. ② Korean law applies to e-commerce lawsuits filed between "Wexport" and users.
